　　XMHOUSE消息 （文/王丽群）12月5日，厦门迎来的年末首场土地拍卖会上，海沧区和翔安区的楼面价均创新高，增加了房价上涨预期，也让不少开发商有了惜售心理。不过，下个月起，开发商更没有空子可钻了。本网从厦门市国土资源与房管局获悉，《厦门市商品房预售管理规定》（以下简称《规定》）已经日市人民政府第40次常务会议通过，自日起施行。
　　门槛提高
　　8层以上商品房须建成一半才可预售
　　《规定》指出，申请预售商品房项目工程形象进度应达到的标准为：7层以下（含7层）的，已完成主体建筑封顶工程；8层以上（含8层）的，完成主体结构工程的二分之一以上，且不得少于7层。此外，在商品房预售方案部分还要求必须提供车位（库）出售或者出租的方案。
　　对此，业内人士分析，新规意味着预售门槛提高，对开发商的资金要求也相应提高，对抑制“地王”出现也有积极作用。对购房者而言，也属利好。
　　房源信息透明
　　捂盘将被罚款并计入预售人信用档案
　　《规定》指出，对已取得预售许可的商品房项目，预售人应当在取得商品房预售许可证之日起10日内一次性公开全部预售房源及每套的价格。违反此规定，将由预售主管部门责令改正，并处10000元以上30000元以下罚款，并记入预售人信用档案。
　　此外，对于商品房预售方案，新规做了详细规定：包括预售商品房的可售房源幢数、套数、面积，以及每套房屋的房号、面积、销售单价和总价、用途等内容；车位（库）出售或者出租的方案等。另外，新规还强调，预售商品房项目可以分期、分幢申请预售许可，但不得分层、分单元申请。如此一来，房源信息更透明，开发商就无法借助分层、分单元这样的慢节奏预售申请方式来捂盘惜售了。
　　《规定》要求，预售商品房项目竣工验收后，预售人应当向预售主管部门申请办理商品房现售备案。取得商品房现售备案证明后，原商品房预售许可证自动失效。
　　未取得商品房预售许可证
　　不得变相收取定金、预定款等费用
　　《规定》还要求，未取得商品房预售许可证，不得以认购、预订、排号、发放贵宾卡等方式收取或者变相收取定金、预定款等费用；不得以返本销售、售后包租等方式预售商品房等。
　　对此，业内人士认为，如此细化的规定，会让开发商更加规范自己的行为。相关部门表示，修订此规章，是为了有效化解商品房预售风险，最大限度地保障购房人合法权益。
