你好，我办的是手机分期付款项当时是在一个手机店，贷的是达飞金融，当时他们是随便给我添了一个5000多的手机价钱但私下我没要手机，拿的是钱首付是510但我那到了是2000多将近3000还有2000多没给我后来还了3000还差2000多，有几个月没还了、他们说要起诉我，后面经常打电话给我服务态度不好，说话语气难听，而且之前他们说过不会给我家里晓得我是贷的钱而是手机，之后哟都不想还了，她们打电话我也不接了，结果他们经常给我家人发信息打电话，到底他们给我家人咋说了，自己就不知道了，现在还发了条什么我触犯了法律什么什么了告我诈骗罪5年以下，罚款2万之20万，请问他们这样是违法了吗。
