上海交通大学硕士学位论文WTO例外条款之工具性价值研究姓名：马征申请学位级别：硕士专业：国际法指导教师：胡加祥WTO例外条款之工具性价值研究摘要例外条款在WTO制度中一直引人关注，因为其不同于原则性的义务规定，从表面看来似乎与WTO整个机制的运行目的相悖。但是，随着WTO的发展，援引例外条款的并不在少数，而在多项协定中亦可看到“一般例外”和“安全例外”的影子。如果从哲学角度说存在即是合理，那么例外条款的内在价值从法哲学的角度来看也是值得研究的。本文认为，例外条款的研究价值的切入点在于其工具性价值，而且着眼点在于两处：第一，工具性价值的工具性体现；第二，工具性价值是为目的性价值所服务的。在通过法哲学和国际法角度对这一对价值进行分析后得出结论：WTO例外条款的现代工具性价值就在于其衡量性，具体通过利益平衡的手段来无限接近WTO的目的性价值——最优化的全球贸易自由。正因为与例外条款工具性价值紧密相连的是WTO中各种利益的并存和冲突，而利益的冲突也大致可以分为三个方面：成员方之间的冲突、自由贸易与成员方国内政策间的冲突以及自由贸易与社会公共利益诸如绿色壁垒等的冲突问题，所以后文会通过一般例外条款模糊用词解释这一角度分析例外条款工具性价值的“工具性”体现。在第四部分，本文会结合与WTO例外条款紧密相关的环境保护和公共健康问题进一步阐述例外条款法条群的工具性价值如何进行衡平的。本文作者试图证明，正是由于例外条款有其工具性价值，才能与WTO的原则性规定一起更好地推动WTO全球贸易自由化的进程。关键词：法的工具性价值，一般例外条款，安全例外条款，利益法学，环境保护，公共健康　ARESEARCHONINSTRUMENTALVALUEOFWTOEXCEPTIONALCLAUSESABSTRACTTheexceptionalclausesareveryspecialunderthemechanismofWTObecauseitseemsthattheyarenotoperatinginaccordancewiththeultimatepurposeofWTO.Buttheexceptionalclausesdevelopquickly,notonlybecausemanyissuesarisefromthem,butalsobecausetheyareinsertedintomanyWTOagreements.Allandallthatisrationalisreal,soaretheexceptionalclauses.Thecoreofthisresearchistheinstrumentalvalueoftheexceptionalclauses.What'stheinstrumentalvalue?What'stherelationshipbetweeninstrumentalvalueandthepurposefulvalue?ThesetwowillbestatedinthisthemecloselywiththeinterestsexistingundertheWTO.TheconclusionisthattheinstrumentalvalueoftheexceptionalclausesisweightingandbalancingtohelpWTOtoreachitsgoal,whichwillbeonthebaseofcasesanalysis.Interestscolliding,whichhavestrongtieswiththeexceptionalclauses,canbedividedintothreekinds:theconflictsbetweenmembersofWTO,theconflictsbetweenfreetradeandnationalpoliciesandtheconflictsbetweenfreetradeandsocialpublicinterests.Inthethirdchapter,theinstrumentalvalueofexceptionalclauseswillbeelaboratedthroughcaseanalysisofgeneralexceptionsbyrulesofinterpretation.Inthefourthchapter,furtherstudyoftheinstrumentalvalueisplannedfocusingontwotopics:environmentprotectionandpublichealthywhicharetwospecialexceptionalclauses.
